Homemade wills / post office wills / online wills templates
Many of my estate planning clients ask me about the risks of making their own will, without input from a legal practitioner.
Whilst “homemade wills” can often do the trick, in my experience there are often serious flaws in homemade wills that can have disastrous consequences after the will maker’s death.
Homemade wills can be particularly problematic in situations where there are: blended families, significant assets held in trusts or superannuation funds, specific gifts of a high value, children that are disinherited and evidence of cognitive incapacity of the will maker (to name just a few).
A homemade will that is improperly drafted can give rise to years of costly litigation and family in-fighting that far outweighs the cost savings of a homemade will.
The cost of a properly drafted will is a small price to pay in comparison to the potential costs of an error in a homemade will.
